Terms of Use
These Terms of Use govern access to and use of Hyperstruck, provided by HYPERSTRUCK PTY LTD (ABN 18 697 361 738).

Using Hyperstruck
Hyperstruck may be used only for lawful business purposes and in accordance with these terms, applicable laws, product documentation, and any order form or written agreement with Hyperstruck.
Customers are responsible for invited users, credentials connected to an account, submitted customer content, and decisions made using outputs generated through Hyperstruck.
Acceptable use
- Attempts to gain unauthorized access to Hyperstruck, customer data, infrastructure, accounts, or networks are prohibited.
- Probing, scanning, overloading, disrupting, reverse engineering, or bypassing security, rate limits, usage limits, or access controls is prohibited.
- Unlawful, abusive, harassing, defamatory, discriminatory, exploitative, malicious, or infringing content must not be uploaded or processed.
- Use of Hyperstruck to generate malware, facilitate cyber abuse, conduct unauthorized surveillance, or make high-risk decisions without appropriate human review is prohibited.
- Outputs must not be misrepresented as human-generated where doing so would be deceptive or unlawful.
Access may be suspended or restricted where use of Hyperstruck creates security, legal, operational, reputational, or platform integrity risk.
Limits and fair use
Documented product, rate, storage, concurrency, and usage limits must be respected. Attempts to avoid billing, quotas, access rules, or technical limits are prohibited.
Limits may be adjusted and usage may be throttled to protect service reliability, prevent abuse, or comply with upstream provider constraints.
Customer content and AI outputs
Customers retain ownership of customer content submitted to Hyperstruck. Hyperstruck receives the rights needed to host, process, transmit, and display that content to provide and secure the service.
AI outputs may be inaccurate, incomplete, or unsuitable for a particular purpose. Customers are responsible for reviewing outputs and deciding whether they are appropriate for the relevant use case.
Third-party services and customer-managed keys
Hyperstruck depends on third-party subprocessors and infrastructure providers. Customer-connected services, credentials, repositories, systems, and LLM keys must be used with appropriate rights and in compliance with the applicable third-party terms.
Where Customer Personal Data is processed through Hyperstruck, the Data Processing Addendum applies and is incorporated by reference into these terms.
Confidentiality and security
Each party must protect the other party's confidential information using reasonable care and use it only for purposes related to providing or using Hyperstruck.
Hyperstruck must be notified promptly of known unauthorized access to an account, credentials, or customer content.
Intellectual property
Hyperstruck, including the software, product design, documentation, names, logos, and underlying technology, is owned by Hyperstruck or its licensors. These terms do not transfer ownership of Hyperstruck intellectual property.
Disclaimers and liability
To the maximum extent permitted by law, Hyperstruck is provided on an "as is" and "as available" basis, without warranties that it will be uninterrupted, error-free, or meet every requirement.
Nothing in these terms excludes, restricts, or modifies any right or guarantee that cannot lawfully be excluded under applicable law.
Indemnity
Customers agree to indemnify and hold harmless Hyperstruck, its officers, employees, contractors, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from customer content, use of Hyperstruck, connected third-party services, breach of these terms, or violation of law or third-party rights.
Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.
